These Terms and Conditions (the “Terms”) govern the booking and provision of services offered by El Agustín, including retreats, monthly dinners, and private events. By making a reservation or paying a deposit, you (“the Client”) acknowledge that you have read, understood, and accept these Terms.

2. Services covered

These Terms apply to the following services:

  • Retreats — multi-day curated experiences with accommodation, meals, and programming.
  • Monthly dinners — themed Saints & Sinners dinner events, single-evening reservations.
  • Private events — full or partial property hire for weddings, celebrations, corporate retreats, and similar private gatherings.

Specific details (dates, included services, dress code, location within the property) are provided at the time of booking and form part of the contract.

3. Booking process and contract formation

Bookings are made through direct contact (email, phone, or contact form). The booking process is as follows:

  1. Inquiry: the Client contacts El Agustín with their requested dates and details.
  2. Proposal: El Agustín responds with availability, pricing, and a written proposal.
  3. Confirmation: the Client confirms by accepting the proposal in writing (email is sufficient) and paying the required deposit.
  4. Contract formation: the contract is formed when El Agustín receives the deposit and sends written confirmation. Until both conditions are met, no reservation is held.

For private events, a separate event agreement may be required, which will prevail over these Terms in case of conflict on event-specific matters.

4. Pricing and payment

Prices. All prices are quoted in Euros (€) and include applicable VAT (IVA) unless expressly stated otherwise. Prices for retreats and private events are confirmed at the time of booking and remain fixed for the confirmed reservation.

Deposits. A non-refundable deposit is required to confirm any booking:

  • Retreats: 50% of the total price, due upon confirmation. The remaining balance is due 30 days before the start date.
  • Monthly dinners: 100% of the price, due at the time of booking.
  • Private events: 30% of the total price, due upon confirmation. A second payment of 40% is due 60 days before the event. The final balance (30%) is due 14 days before the event.

Payment methods. Payment is accepted by bank transfer or by secure payment link (processed by Stripe). Bank details and payment links are provided with the booking confirmation.

Late payment. Failure to pay any installment by the due date entitles El Agustín to cancel the booking and retain all amounts already paid as compensation.

5. Cancellation policy

In accordance with Article 103.l of Royal Legislative Decree 1/2007 (TRLGDCU), services involving accommodation, catering, or leisure activities provided on a specific date or during a specific period are exempt from the 14-day right of withdrawal that applies to most consumer contracts. Accordingly, the following cancellation terms apply:

5.1 Cancellation by the Client

Retreats:

  • More than 60 days before start date: 50% deposit retained; remaining balance, if paid, refunded.
  • 60–30 days before: 50% deposit retained; if full payment has been made, an additional 25% retained.
  • Less than 30 days before: 100% of the total price retained.

Monthly dinners:

  • All cancellations: 100% of the price retained, regardless of notice. Reservations are non-refundable. Where possible at El Agustín’s discretion, the reservation may be transferred to a future dinner of equivalent value within 6 months.

Private events:

  • More than 90 days before: 30% deposit retained.
  • 90–60 days before: 70% retained (deposit + second payment).
  • Less than 60 days before: 100% of the total price retained.

All cancellations must be made in writing (email).

5.2 Cancellation by El Agustín

In the unlikely event that El Agustín must cancel a booking due to circumstances within our control, the Client will receive a full refund of all amounts paid. This is the sole remedy and El Agustín shall not be liable for consequential losses (travel, time off work, etc.).

5.3 Force majeure

Neither party is liable for failure to perform due to events beyond reasonable control, including natural disasters, government restrictions, pandemics, strikes, or acts of war. In such cases, El Agustín will offer, at its discretion: (a) rescheduling to an equivalent date within 12 months, or (b) a credit valid for 12 months. Refunds in force majeure situations are at El Agustín’s discretion and are not guaranteed.

5.4 Travel insurance

We strongly recommend that all Clients purchase comprehensive travel insurance covering cancellation, medical expenses, and personal liability. El Agustín is not responsible for losses that would have been covered by appropriate insurance.

6. Client obligations

By booking, the Client agrees to:

  • Provide accurate identification and contact information.
  • At check-in (for retreats and stays), present valid identification documents as required by Royal Decree 933/2021 and Spanish hospitality law.
  • Respect the property, staff, other guests, and the surrounding community.
  • Comply with all property rules, including those related to noise, smoking, pets, and use of facilities.
  • Disclose at the time of booking any dietary restrictions, allergies, accessibility needs, or relevant medical conditions.
  • Behave in a manner consistent with the boutique character of the property. El Agustín reserves the right to refuse service or terminate a stay without refund in cases of disruptive, disrespectful, or unsafe behavior.

7. Damages and liability

The Client is responsible for any damage caused to the property, furnishings, or equipment by themselves or members of their party. El Agustín may charge the cost of repair or replacement to the Client.

El Agustín maintains civil liability insurance as required by Spanish hospitality regulations. Our liability is limited to direct damages caused by our own negligence and shall not exceed the amount paid by the Client for the service in question. We are not liable for:

  • Loss or theft of personal belongings (a safe is available where applicable).
  • Personal injury arising from activities undertaken at the Client’s own initiative.
  • Disruptions caused by third parties or force majeure events.
  • Consequential or indirect damages of any kind.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be limited under Spanish law.

8. Photography and image rights

El Agustín may take photographs and video at retreats, dinners, and events for marketing and editorial purposes. By attending, the Client consents to being photographed in general scenes. Clients who do not wish to appear in identifiable images may notify staff in writing before the event, and reasonable efforts will be made to honor this request.

For private events, image use is governed by a separate clause in the event agreement.

9. Personal data

Personal data provided in connection with a booking is processed in accordance with our Privacy Policy, which forms part of these Terms.

10. Intellectual property

All content provided in connection with retreats and events (programming materials, recipes, written content, the Saints & Sinners brand and concept) remains the intellectual property of El Agustín. Clients may not reproduce, distribute, or commercially use this content without prior written authorization.

11. Modifications

El Agustín reserves the right to make minor modifications to advertised programming, menus, or activities for operational reasons. Material changes will be communicated to the Client, who may then choose to (a) accept the modified booking, or (b) cancel with a full refund.

12. Complaints and dispute resolution

Complaints should be addressed first to El Agustín in writing at hola@elagustin.es. We commit to responding within 15 business days.

Official complaint forms (hojas de reclamaciones) are available at the property, as required by Galician consumer protection regulations.

In accordance with Regulation (EU) 524/2013, consumers may use the EU Online Dispute Resolution platform: ec.europa.eu/consumers/odr.

13. Applicable law and jurisdiction

These Terms are governed by Spanish law. Any dispute arising under these Terms shall be subject to the courts of Pontevedra, without prejudice to the consumer’s right under applicable law to bring proceedings in the courts of their own country of residence.

14. Severability and entire agreement

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in full effect. These Terms, together with the booking confirmation and any specific event agreement, constitute the entire agreement between the parties.
